Rural community’s right to the land in the context of administrativeterritorial reform

One of the main tasks of decentralization reform is strengthening of the role of territorial communities with granting them the right to dispose the land which is within the limits of their settlements and beyond. Although, as a result of processes of their association it can happen so that smaller communities of the villages and settlements will actually lose this possibility. While examining this question and analyzing current draft legislation on bringing amendments to the land legislation of Ukraine, the author comes to the conclusion that, unfortunately, the actual condition of state and municipal land resources as well as the present practice of land-use are not taken into account to the full extent in the process of decentralization in the field of regulation of the land relations. And it, in its turn, substantially influences on the quality and adequacy of the innovations of the legal regulation of the land relations, especially in terms of defense of rights to the land of rural communities.
