Genesis of development of “abuse of the right” category

Lately “abuse of right” category is used often enough in modern legal usage. It is testified not only by theoretical and doctrine searches but also by numerous law enforcement decisions. This concept is especially important for judicial practice because the courts all more frequent consider it as a legal institute which enables to settle this or that dispute in essence.
